PC World ripped me off £2000 and rising £10/month losing broadband I have no pc to use!

They sold me a lap top that was not what the sales ticket said and doesn't do what the staff, the sales ticket or the machine states! PC World have refused to refund me. I have requested a prosecution from Trading Standards and requested a compensation order to recover my losses.

I visited PC World Selly Oak, Birmingham December 2007 in search of an entertainment and business lap top. I wanted to teach myself how to use the business programs I have at work to help me pursue promotion.

A PC World member of staff sold me a Dragon HP laptop promising 4GB Ram, Genuine Business Vista, no disc support as the machine had a one time back up action and self recovery feature by disc or hard drive and came fully loaded with Microsoft Office 2007 worth £500.

I discovered no software on the machine on the one time back up.

PC World sold me, under the guise of "meeting me more than half way" the £500 software for £145 and loaded it on the machine for me. They gave to me an empty box with the product code stating the recovery feature would always restore the lap top and all software on it in keeping with the no discs required feature.

The lap top failed mid October'08. Attempting for 3 weeks the recovery process without success led to help. My friend showed me the computer had 3GB, Home Premium Vista and the self recovery feature didn't work.

November'08 I told PC World this and asked for refund or replacement to the value. The manager asked for an opportunity to inspect saying if they found any one of those differences they would refund or replace with the computer of my choice, stating 24 hours as the time they needed.

PC World took 2 weeks getting it working; got it "to read 4GB", acknowledged Home Premium not Business Vista; and, said the self recovery feature deleted the Microsoft Office software. The manager said that an OEM had been supplied instead of the £500 software and he refused to give it now. He promised to copy it and give it back with the lap top after loading it on the machine and told me to write to their head office who would supply the Business Vista.

PC World then refused to copy the Microsoft Office Software offering the Student £80 version instead! I rejected that offer, took the laptop and wrote to PC World Head Office and HFC Bank asking for a refund, replacement or the £500 software and the Genuine Business Vista.

Several letters to March'09 saw the laptop fail completely and PC World head office: refusing to refund or replace it, to supply the £500 software saying the store had offered the Student version of Office worth £80; and, that their investigations failed to show any evidence of misrepresentation. PC World also mentioned that I have a photograph of the sales ticket that they would like to see.

I handed in a copy ticket to the store who still refused to refund or replace the laptop but asked me to pay £229 to fix it. I sent a copy ticket to Trading Standards.

HFC Bank rejected my claim for a refund under s75 Consumer Credit Act.

I've been completely ripped off by PC World and HFC bank rejected any responsibility for this under s75 Consumer Credit Act.

I've reported PC World to Trading Standards for prosecution under s1 Trades Description Act 1968 and requested a compensation order for my losses.

I had to give a star to have this review published.

Summary: PC World rip the British public off and their licence to trade should be lost!

Goosey - Thanks mate. Ombudsman? You're right but I'm also wondering if the FLA might lead me to a refund sooner. I think the BBC News had something on banks refusing to accept their responsibility under s75 CCA.

Naomi - Prosecution pending is the hope. It is Trading Standards duty to prosecute traders who break the law under section 1 TDA. Very useful if you want to avoid the cost of taking action yourself. Trading Standard have asked me to wait 7 days for PC World's head office response.

What is most disturbing is that PC World's conduct has raise 335 complaints. This might be a drop in the ocean as many might have chosen to do nothing. If PC World lost its licence that would equate to lost jobs. As a minimum PC World need to train their staff, respect consumer rights and resolve fairly consumer disputes.

My experience with PC world (Yeovil) has been fautless. However, it sounds as if Selly Oak have employed some shifty workers. Good luck with your prosecution process. I hope you get a refund plus compensation. Have you considered the Ombudsman?

I brought a laptop recently from PC World, and I made sure I got my mum to ask all the important questions. I'm a computing student, well was, so I know what I wanted, but I always like to see if the salesman knows what they are talking about to a 'normal user'. I have to say the girl was good, however she did fail on a few things that I had to disagree with. the biggest problem was when I said I wanted a keyboard with it, she went to get it and put it in the bag. She sold me one with the wrong connection on it, and we had to go back in and get it changed. Good luck with your prosecution. Kirsty
