My wife is a big fan of merry Hill and shops there at least twice a week and has done so since it opened. On Monday 28 February she went shopping with her friend and slipped in the mall outside Clarks shoe shop on the ground floor. She is in her sixty's and was shook up by the fall, she also thought she had hurt her arm and her friend drove her home without reporting the accident. My daughter insisted she went to hospital when she saw her about an hour later and an x-ray revealed she had broken her arm which has resulted in a plaster cast for a six week period.

We returned to Merry Hill on Saturday 05 March and reported the accident to the security guard who made a note of the particulars and wanted to know why she had not reported it at the time. We told him she was alarmed by the fall and just wanted to get back home, she did not think the arm was broken at the time.

We have since heard about several similar incidents and there is no doubt the floor is slippy, it is a polished terrazzo tile floor. I wonder how many accidents have happened because of this and what action the owners take to reduce the risk?

We did approach no win no fee firms of solicitors, the one was trading in Merry Hill and said their terms of trading with Merry Hill owners forbade them from taking on cases which occur in the shopping centre, another firm said they get no fee unless they win a case and if there was no water etc on the floor it would be unlikely they would win and were therefore not prepared to take on the case.
