I have just been looking on the site while preparing to take on Fasthosts after being ripped off by them. It seems to be the same old story mnay people have had - changed card details and got automated mail saying payment failed. repeatedly tried to change card details on their site, even mailing them to said have already done so, only to be ignored, then have £23.50 withdrawn from my account with no warning. Contested with my bank and had reversed, only for it to be taken again. changed card details again, to protect my account from them dipping their fingers in every 5 minutes, just in time by looks of it, as they now want £60 for the fact that I contested their inflated charges!!! have not used account, as has benn froxen since last year, and have now transferred my email hosting. when I tried to cance account this week and request all info held be destroyed, they said was suspended, and wont close until further charges paid!!

Am using same principles I used to get my money back from my bank for their excessive charges, As if all major banks cant legaly justify £20-£30 charges for letter that costs pence, how can fasthosts?? All I received was automated emails, and was unable to update my details on their site anyway, so is obvioulsy ploy to be able to apply very profitable penalty charges, especially as so many people seem to have been caught by the same scam. I am going to be sending them the same letter citing:
the Unfair Terms in Consumer Regulations 1999. In addition I believe that your charges are a Penalty. Penalty charges are irrecoverable at common law. The precedent for this was Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] AC 79 along with Murray v. Leisure play [2005] EWCA Civ 963. It was held that a contractual party can only recover damages for an actual loss or liquidated losses. It is clear that your charges do not reflect any actual and or real loss.


Would like to hear from anyone who has had similar experiences. About time Fasthosts poor reputation was explained to the masses before more people get ripped off. Maybe a group can get together and file a case to be used as a test case? If we can win one, it would set a simliar precedent, and with all our combined evidence, ie everyone having problems changing details, I dont see how they can defend themselves.

Summary: Do not touch. tempted by low costs, then charged "penalty charges" over weekends!

I have personally been using Emberhost for my hosting for the past two years. I have had excellent customer service from them. perhaps you should give them a try.
